Terms of Service

This website, acgal.in (the “Site”), is operated by ACGAL, the non-profit arm of The Antonym Collections. Throughout the Site, “we”, “us”, and “our” refer to ACGAL. These Terms of Service (“Terms”) govern your access to and use of the Site, and your application to or participation in any residency, workshop, event, or other programme we run (each, a “Programme”).

By visiting the Site, submitting an application, or registering for a Programme, you agree to be bound by these Terms. If you do not agree, please do not use the Site or apply to a Programme.

1. Eligibility & Site Use

You must provide accurate, current, and complete information wherever the Site asks for it, including in any application or registration form. You may not use the Site for any unlawful purpose, or in a way that infringes anyone else's rights, transmits viruses or malicious code, or attempts to interfere with the Site's normal operation.

2. Applications & Selection

Submitting an application does not guarantee a place on a Programme. Where a Programme has limited seats — for example, a residency with a fixed cohort size — selection is made at ACGAL's discretion, based on criteria communicated at the time of application (which may include a mentor's or jury's assessment).

Selection decisions are final. As a general policy, we do not provide individual feedback to applicants who are not selected, unless we state otherwise for a specific Programme.

We reserve the right to extend, shorten, or otherwise change an application window, or to cancel a Programme cycle, before announcing results, and will communicate any such change on the Site or by email to applicants.

3. Programme Fees

Where a Programme carries a fee, the amount and what it covers (for example, accommodation and meals for a residency) will be stated on the relevant Programme page at the time you apply. Fees, once introduced, are subject to change for future Programme cycles but will not change for a cycle you have already been confirmed into. 4. Intellectual Property in Your Submissions

Any creative work, story, portfolio material, or other content you submit as part of an application or Programme remains yours — you retain copyright in it. Where a Programme's terms grant ACGAL or Antonym publication or promotional rights over work created during that Programme (for example, the right to publish a piece that results from a residency), those terms will be stated clearly for that specific Programme and will not be broader than what you're told at the time you apply or are confirmed.

By submitting an application, you confirm the material you submit is your own original work, or that you have the right to submit it, and that it does not infringe anyone else's rights.

5. Comments & Other Submissions

If you send us feedback, suggestions, or other unsolicited material, you agree we may use it without restriction and without any obligation to compensate you or keep it confidential. We may remove or decline to use any submission that we consider unlawful, offensive, or otherwise inappropriate.

6. Prohibited Uses

You agree not to use the Site or any Programme process to:

  • Violate any applicable law or regulation;
  • Infringe our intellectual property rights or those of others;
  • Harass, defame, or discriminate against any person;
  • Submit false or misleading information in an application;
  • Upload viruses or malicious code, or attempt to interfere with the Site's security or normal functioning;
  • Scrape, crawl, or harvest data from the Site beyond normal browsing.

7. Third-Party Links & Tools

The Site may link to third-party websites or use third-party tools (for example, application forms or payment processors) that we don't control. We're not responsible for the content, accuracy, or practices of third-party sites or tools; please review their own terms and privacy practices separately.

8. Accuracy of Information

We aim to keep Programme details — dates, fees, eligibility, venue — accurate and current, but we don't guarantee the Site is free of errors or omissions, and we may correct or update information at any time without prior notice.

9. Disclaimer & Limitation of Liability

The Site and our Programmes are provided on an “as is” and “as available” basis, without warranties of any kind, to the fullest extent permitted by law. To the fullest extent permitted by law, ACGAL, its directors, staff, mentors, and affiliates will not be liable for any indirect, incidental, or consequential loss arising from your use of the Site or participation in a Programme, except where that liability cannot be excluded under applicable law (for example, in the case of injury caused by our negligence).

10. Indemnification

You agree to indemnify and hold ACGAL, The Antonym Collections, and their directors, staff, and affiliates harmless from any claim arising out of your breach of these Terms, your submissions, or your violation of any law or third party's rights.

11. Termination

We may suspend or terminate your access to the Site, or withdraw you from a Programme, if you breach these Terms. Obligations that by their nature should survive termination (for example, confidentiality or IP provisions) will continue to apply.

12. Governing Law

These Terms are governed by the laws of India. The courts at Kolkata, West Bengal shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site or participation in a Programme after changes are posted means you accept the updated Terms.
